Acceptance
By using Daymarkr, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Daymarkr.
Not Medical Advice
Daymarkr is decision-support software. It is not medical advice, diagnosis, treatment, prescribing, pharmacy, telehealth, emergency care, or a substitute for a licensed clinician.
You are responsible for decisions about your health, medications, supplements, peptides, labs, dosing, and care. Always consult qualified healthcare professionals. In an emergency, call emergency services immediately.
Daymarkr does not sell peptides, drugs, prescriptions, medical services, or pharmacy services.
Eligibility
You must be legally able to use Daymarkr in your location. Daymarkr is intended for users who are at least 17 years old. Do not use Daymarkr if you are prohibited from doing so by applicable law.
Your Account
You are responsible for keeping your account secure, providing accurate information, all activity under your account, and maintaining access to the email, Apple, or Google account used to sign in. We may suspend or terminate access if we believe your account is being used unlawfully, abusively, or in violation of these Terms.
Subscriptions and Purchases
Daymarkr may offer paid features through auto-renewable subscriptions, such as Daymarkr Pro. Subscriptions are purchased through Apple In-App Purchase. Apple handles billing, renewal, cancellation, and refunds. You can manage or cancel subscriptions in your Apple account settings.
Subscription features, prices, trials, and availability may change before purchase or renewal, subject to App Store rules and applicable law.
User Content
"User Content" means information, files, photos, lab reports, COAs, protocol posts, notes, reports, and other content you enter, upload, create, or publish in Daymarkr.
You keep ownership of your User Content. You grant Daymarkr a limited license to host, process, display, analyze, transmit, and use your User Content as needed to provide, secure, improve, and support Daymarkr. You are responsible for your User Content and must have the rights needed to upload or share it.
Community Content and Moderation
If you publish community-visible content, other users may be able to view it. Do not publish content that is unlawful, harassing, deceptive, dangerous, invasive of privacy, infringing, or otherwise harmful. We may review, remove, limit, or moderate community content and reports at our discretion.
Prohibited Uses
- Break the law or encourage unlawful conduct.
- Buy, sell, source, distribute, or facilitate access to illegal or controlled substances.
- Provide medical advice, diagnosis, treatment, prescribing, or emergency guidance to others.
- Upload content you do not have rights to use.
- Harass, threaten, abuse, impersonate, or deceive others.
- Attempt to reverse engineer, scrape, disrupt, or compromise Daymarkr.
- Bypass subscription, quota, security, or access controls.
- Submit false, manipulated, or misleading verification or COA records.
AI, Calculations, and Interpretation
Daymarkr may use software, calculations, rules, and AI-assisted processing to parse labels, labs, records, and other user-selected content.
These outputs can be incomplete, inaccurate, or misunderstood. You must review outputs before relying on them. Daymarkr does not guarantee that calculations, OCR, AI results, lab interpretations, vendor records, COAs, or community content are accurate, complete, safe, current, or suitable for your situation.
Vendor, COA, and Public Records
Daymarkr may display vendor, COA, lab-test, public-record, or community-submitted information. This information is for decision support and recordkeeping only. It is not an endorsement, certification, safety determination, recommendation, or source marketplace.
Privacy
Our Privacy Policy explains how we collect, use, and share information. By using Daymarkr, you agree that we may process information as described in the Privacy Policy.
Intellectual Property
Daymarkr, including its software, design, text, graphics, logos, features, and related materials, is owned by us or our licensors and is protected by law. You may not copy, modify, distribute, sell, lease, or create derivative works from Daymarkr except as allowed by these Terms or applicable law.
Third-Party Services
Daymarkr depends on third-party services such as Apple, Google, Supabase, RevenueCat, Sentry, PostHog, OpenRouter, Expo, and others. We are not responsible for third-party services, outages, policies, or content.
Disclaimers
Daymarkr is provided "as is" and "as available." To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.
Limitation of Liability
To the maximum extent allowed by law, Daymarkr will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, health decisions, medical outcomes, procurement decisions, or reliance on app outputs.
Our total liability for any claim will not exceed the greater of the amount you paid to use Daymarkr in the three months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
Indemnity
You agree to defend, indemnify, and hold harmless Daymarkr from claims, damages, liabilities, costs, and expenses arising from your use of Daymarkr, your User Content, or your violation of these Terms.
Termination
You may stop using Daymarkr at any time. You may delete your account in the app. We may suspend or terminate access if needed to protect Daymarkr, users, or legal compliance.
Apple Terms
If you downloaded Daymarkr from the Apple App Store, Apple is not responsible for Daymarkr or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms as required by App Store rules. Apple's standard End User License Agreement may also apply unless a custom license is provided in App Store Connect.
Governing Law
These Terms are governed by the laws applicable to the operator of Daymarkr, without regard to conflict-of-law principles, unless a different rule is required by applicable law.
Changes
We may update these Terms. We will update the effective date when changes are made. Continued use of Daymarkr after changes means you accept the updated Terms.
